01Who we are

Media Systems LLC is a limited liability company registered in the State of Delaware, United States, doing business as Site Scaling. In this policy, "Site Scaling," "we," "us," and "our" refer to Media Systems LLC DBA Site Scaling.

We provide website design, rebuilding, hosting, search engine optimization, conversion testing and related growth services to businesses in the United States. This policy applies to this website and to the communications we send to people who contact us, request an audit, become clients, or subscribe to our messaging programs.

We are responsible for the personal information described in this policy. Our full contact details are in Section 14.

02Information we collect

We collect only what we need to respond to you and to deliver our services.

Information you give us

Information we collect automatically

When you visit our website we collect standard technical information: IP address, browser type and version, device type, operating system, referring page, pages viewed, and the dates and times of those visits. We use this to keep the site working, to understand which content is useful, and to detect abuse.

What we do not collect

We do not collect payment card numbers or bank account details through this website; payments are handled by our payment processor. We do not knowingly collect government identification numbers, health information, biometric data, or precise geolocation.

03How we use information

We use the information described above to:

• Respond to your enquiry and prepare the site audit you requested
• Deliver, host, maintain and improve the websites and services you signed up for
• Contact you about your project, your account, appointments and billing
• Send you the email and SMS messages you have specifically asked to receive
• Provide customer support and answer your questions
• Keep records of the consent you have given us, which we are required to keep
• Operate, secure, troubleshoot and improve our own website
• Detect and prevent fraud, abuse and unauthorized access
• Comply with our legal, tax and regulatory obligations

We do not sell your personal information, and we do not rent or trade it. We do not use automated decision-making that produces legal or similarly significant effects about you.

04SMS text messaging program

Site Scaling operates an SMS text messaging program for people who explicitly ask to receive text messages from us. Taking part is entirely voluntary.

How you opt in

You join our SMS program only by taking a clear, affirmative action: ticking a dedicated, unchecked SMS consent box on a Site Scaling form and providing your mobile number. SMS consent boxes are always separate from any agreement to our Terms of Service, are never pre-ticked, and are never required to submit a form.

We ask for two separate SMS consents. You may give either, both, or neither:

We only send marketing texts if you ticked the marketing box. Replying STOP to any message stops all messages.

Confirmation message

After opting in, you will receive a confirmation message: "Site Scaling: You're subscribed to texts from Media Systems LLC DBA Site Scaling. Messages may include account updates, appointment reminders and, if selected, offers. Msg frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to opt out."

Supported carriers

Supported US carriers include AT&T, T-Mobile, Verizon, Boost, Cricket, MetroPCS, US Cellular and most other major carriers. Carriers are not liable for delayed or undelivered messages.

Consent records

When you opt in, we record the date, time, IP address and the exact disclosure text you agreed to. We keep this record for as long as you remain opted in, and afterwards for as long as we need it to show that the consent was properly obtained.

05Mobile information and third parties

Your mobile phone number and your SMS opt-in are treated differently from every other category of information we hold. They are subject to the following commitment:

In plain terms: we will never sell, rent, or hand your mobile number or your SMS consent to another company so that they can market to you. The only parties who ever see it are the service providers who help us deliver our own messages and support you, described in Section 06, and they may use it only for that purpose.

06How we share information

We share personal information only in the limited circumstances below.

Mobile information and SMS opt-in data are excluded from all sharing other than the service-provider category above, as stated in Section 05.

07Cookies and tracking

We use a small number of cookies and similar technologies. Strictly necessary cookies keep the site working and secure. Analytics cookies help us understand, in aggregate, which pages people find useful.

You can block or delete cookies in your browser settings. Blocking strictly necessary cookies may stop parts of the site from working. We do not use cookies to build advertising profiles about you across unrelated websites.

08Data on client websites

When we build or host a website for a client, that website may collect information from its own visitors, for example through contact forms. For that information, our client decides what is collected and why, and we process it only on their instructions to provide our services. Visitors to a client's website should read that client's own privacy policy, and direct any requests about that data to the client.

09Data retention

We keep personal information only as long as we have a reason to. Enquiry and audit details are kept for a reasonable period after we respond. Client records are kept for the length of our relationship and for a reasonable period afterwards. Marketing contact details are kept until you unsubscribe or opt out. SMS consent records are kept for as long as needed to evidence the consent. Records we must keep for tax, accounting or legal reasons are kept for the period the law requires. When information is no longer needed, we delete or anonymize it.

10Security

We use encryption in transit (TLS), access controls and vetted service providers to protect the information we hold. Account credentials you share with us are stored in a password manager and used only for the work you asked us to do. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you and the relevant authorities where the law requires it.

11Your privacy rights

Depending on where you live, you may have the right to:

• Access the personal information we hold about you
• Correct information that is inaccurate or incomplete
• Delete your personal information, subject to our legal retention obligations
• Get a portable copy of information you gave us
• Opt out of marketing email, marketing SMS, or both
• Not be discriminated against for exercising any of these rights

To exercise any of these, email [email protected]. We will verify your identity before acting, and respond within the time the applicable law requires. You can also unsubscribe from email at any time using the link in any email we send, and from SMS by replying STOP.

California residents. We do not sell or share personal information as those terms are defined by the California Consumer Privacy Act, and we have not done so in the preceding twelve months.

12Children's privacy

Our services are for businesses and are not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has given us information, email [email protected] and we will delete it.

13Changes to this policy

We may update this policy as our services or the law change. When we do, we will revise the "Last updated" date at the top of this page. If the changes are material, we will also give you notice by email or on the website before they take effect.
